Hire;

The following conditions apply whether a contract has been made verbally or in writing. The Hirer acts on behalf of all the passengers travelling. The Hirer is deemed to be the responsible person in all cases of the hire and is responsible for all actions and decisions of passengers on board including any additional costs incurred, whether they are part of the hiring party or not. The Company can only accept instructions from the Hirer. If the Hirer is not travelling a representative must be agreed and nominated and the Company informed prior to hire

Drivers Hours;

The hours of work a driver can do are regulated by European Law, Regulation (EC) 561/2006. Neither the Hirer nor passenger must delay or interrupt the journey in such a way that the driver is breaching regulations. If a breach occurs the Hirer is responsible for additional costs incurred that may require additional or replacement drivers to be arranged.

Quotations;

Quotes are given based on information / Itinerary supplied by the Hirer at the time. The route travelled is at the discretion of the Company unless specified in advance by the Hirer. If the itinerary changes after the initial quotation is given then a review and amended price may be required. Driver breaks will be scheduled as required according to the Itinerary supplied at the time. Vehicles will be charged at a daily rate of hire commencing from first day until last day. Full day rates will be charged for these types of vehicles where the hire goes into any part of the following day where the vehicle would not be able to be used that day.

Vehicle & Facilities;

At the time of booking, vehicle sleeping and seating capacity will be confirmed. If there are any special requirements or facilities required please request availability prior to hire. The Company cannot always honour all requests, especially if at short notice. In the event facilities such as beds, lounge area furniture, tea/coffee machines, TVs, Air Con etc, become damaged or defective, the Company will not be held liable to any Inconvenience or potential damages that may arise. Repairs cannot always be carried out to damage or breakdowns whilst on tour and no responsibility will be taken for Inconvenience or financial loss as a result.

The Company reserves the right to provide a larger vehicle than that specified unless specifically instructed not to do so. In such circumstances, no additional charges will be levied. The Company reserves the right to substitute another vehicle (including those of other operators) or ancillary facilities for all or part of hiring subject to substitutes being of equivalent value.

Trailers;

Trailers are available on request and will be charged. The Hirer is responsible for the insurance of any articles that are carried against theft, travelling, packing or handling breakages in the hired trailer. Any documentation required in the UK and any European country is the Hirer's responsibility. Weight must not exceed 1.5 Tonnes. Any charges for excess weight will be the responsibility of the Hirer.

Hire Variation;

The Company reserve the right to levy additional charges for additional mileage, time or inconvenience that arises whilst on tour. The vehicle will depart and travel at times agreed by the Hirer at the time of the quotation; it is the responsibility of the Hirer to account for all passengers at departure times. The Company will not accept liability for losses incurred by passengers who fail to follow Hirer’s instructions. Additional hire will be charged where unplanned hire goes into any part of the following day restricting hire or use for other purposes.

Confirmation - Payment - Cancellation;

A booking is only confirmed on receipt of a non-refundable deposit of at least £500.00 or 20% (whichever is greater) of the booking total.

Payment must be paid in full 48 hours prior to commencement of hire unless a payment plan has been agreed in advance by the Company.

Cancellation of hire will result in the following scale of charges to be applied:


Prior to 1 month before commencement of hire = Deposit Only


Less than 1 month but greater than 7 days before the commencement of hire 

= 50% of balance outstanding.


Less than 7 days before the commencement of hire

= 100% of balance outstanding.

Cancellation by the Company;

  

In the event of circumstances beyond the Company’s control e.g. civil unrest, strikes, police road closures, terrorist attacks, breakdown etc (including adverse weather and road conditions) or in the event of the Hirer taking any action varying the agreed conditions unilaterally, the Company may, and without further liability, cancel the contract.

Additional Charges;

  

Although every effort is made to consider all aspects when charges are made on the Initial invoice, extra or unforeseen charges such as: Road Tolls, Emission Charges, Parking Tickets, Permits, Fines, Excess Mileage, Internet Use of Over 3 gigabytes Per Session, Additional Days of hire, may be charged on an additional invoice on completion of the tour.

Breakdowns & Delays;

Journey duration is given in good faith. However, in the event of breakdown, traffic congestion or other events beyond the control of the Company, journeys may take longer than expected. In such circumstances, the Company will not be liable for any loss (Financial or otherwise) or inconvenience caused to the Hirer or passengers.

Conduct of Passengers;

The driver is responsible for the safety of the vehicle at all times, and as such may remove any passenger from the vehicle whose behaviour risks safety. The Hirer is responsible for any damage caused to the vehicle by any passenger for the duration of the hire. Where the hire is to a sporting event, the Hirer should be aware of legal requirements relating to alcohol and the conditions of entry to the intended event.

Refreshments & Alcohol;

Food and drink can be brought and consumed on the vehicle. It is the Hirers responsibility to ensure spillages are cleared up and no food, drink or alcohol is left around for long periods that may cause smell, mould or encourage Ants and Insects. In the event a passenger becomes aggressive or unruly due to intoxication the Company reserve the right to remove him / her from the vehicle and refuse entry until further notice.

Passenger Property;

Vehicles are subject to restrictions on carrying luggage for safety reasons. The Hirer accepts that the driver shall be the sole judge as to whether or what extent passenger’s property is carried. Large items may not be able to be carried and the Hirer should notify the Company in advance of any requirements. It is the Hirer’s responsibility to minimise risk of loss when property is left unattended. The Company does not accept Liability for the personal property of the Hirer and passengers and recommends personal insurance be taken.

Damages to Vehicles;

The Hirer is responsible for any damage caused to the vehicles by any passenger or agent for the duration of the hire. Any damage caused will be billed accordingly to the Hirer. This includes interior / exterior vandalism or accidental damage.

Agency Arrangements;

When the Company hires in vehicles or arranges other ancillary services. The terms and conditions imposed by such other suppliers through the Company shall insofar as they are supplied to the Hirer be binding on the Hirer as if they had been directly contracted services.

Advisory of Package Travels Regulations;

If the Hirer organises other elements of a package in addition to the provision of transport, the Hirer may be defined as an organiser or retailer of the Package Tour Regulations and may be required to comply with the provisions of the regulations in the UK & Europe.

Posters & Notices;

No bill, poster or notice is to be displayed on any vehicle without the prior written consent of the Company.

Animals;

No animals (other than guide dogs notified to the Company in writing in advance) may be carried on a vehicle without prior written agreement from the Company.

Complaints;

In the event of a complaint, the Hirer should seek a solution at the time from the driver or Company. If a remedy has not been provided, complaints should be submitted in writing to the Company at its trading address, within 14 days of the end of the hire by Recorded Delivery.

Refunds;

  

In the event of failure of the Company to provide the booked service, due to the fault of the Company, any refund will be limited to the amount paid for that part of the hire if evidence proves Company failure.
